Access to justice in criminal appeals and applications to the Criminal Cases Review Commission (CCRC) is under serious threat. Chronic underfunding of Legal Aid, a shrinking pool of legal providers, and high numbers of unrepresented applicants are materially reducing the ability of individuals to challenge wrongful convictions. These systemic failures risk allowing miscarriages of justice to go uncorrected, undermining public confidence in the criminal justice system.
Immediate action is needed: this includes meaningful fee uplifts, the introduction of interim payments, and proper remuneration for solicitors undertaking work after leave to appeal is granted. Longer-term reform must include a commitment to sustainable Legal Aid funding and structural support for those working to overturn wrongful convictions.
